On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. This dealing must be lodged in conjunction with an Application for recording of action affecting a crown holding (Form 19MA) & Restriction on the use of land vested in a prescribed authority (Form 13RVP) to have effect.

(A) The reference to title for the land burdened by the restriction must be stated.

(C) The prescribed authority must be the State of New South Wales

(D) The relevant annexure must be specified on the dealing itself and the annexure must be identified as such.

The annexure must state the full wording of each notification to be removed on the conversion action.

The registered number of the Application for recording of action affecting a crown holding (Form 19MA) accompanying the dealing will be marginally noted in NSW LRS.

(E) The dealing must be executed by an authorised officer of the prescribed authority (the full name of the officer and the nature of the authority must be stated) and be witnessed.
