On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Dealing type - R

(A) Stamp duty - not required.

NOS form - Required for vesting of land in a Local Council as a drainage/public reserve.

Not required for recording of a drainage reserve on land owned by a Local Council.

Standard form of Caveat - does not prevent registration.

(B) The reference to title for the land affected by the request must be stated.

(C) Does not apply.

(E) The full name of the Local Council in which the drainage/public reserve is to be (or has been) vested must be stated. The name of the Local Council must be identical to the name shown in the Government Gazette notice.

The date and folio number of the Government Gazette must be stated and agree with the copy of the Gazette notice. A true copy of the Gazette notice must be attached to the dealing.

(F) A short description of the nature of the request must be stated.

(G) Full details of the request must be stated.

(H) The dealing must be signed by the general manager, a public officer or authorised officer (the full name and capacity must be stated), or the Local Council's attorney, and must be witnessed. The solicitor for the Local Council may execute the dealing.

(I) This section is to be completed where the notice of sale data (see NOS form above) has been forwarded to NSW LRS through the eNOS facility.
