On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Transfer and road closure

Form   01TX  

NOTE: The Folio of the Register transferred must have been created by a crown road enclosure plan.
This form is for staff use only and must be lodged by DPI-Land. The dealing can only be accepted & processed through TPS.
The dealing cannot be lodged through personal or advanced lodgments.

Dealing type - TX

Stamp duty - required.  The number of title references indicated by Revenue NSW must agree with Note (A).

Any alteration to the title reference, tenancy, interest/share, consideration, or change to the names of the parties must be marked. A minor change in spelling that does not alter the identity of a party may be ignored.  The addition of a name must be marked.

NOS form - Panels 1, 2, 3, 4 and 5 require completion.  Ignore 3A and 4 if the transfer is not for value.

Standard form of Caveat - prevents registration.

Requirements are the same as for a standard transfer, together with the following.

An extra fee is not payable for a notification as regards monies owing entered in the Second Schedule.

(A) The reference to title for the land being transferred must be stated.

(C) The State of New South Wales must be the transferor.

(D) The consideration is optional.  A consideration stated must agree with the purchase price stated in the NOS form.

(E) The number and date of the Government Gazette notice must be stated.  A copy of the notice must be annexed to the transfer.

(F) The situation as regards monies fully paid or owing must be indicated by deleting the inappropriate term.  The deletion must be verified.

(G) The full name of the transferee must be stated.

(H) Tenancy/shares must be stated where there is more than one transferee.

(I) The transfer must be executed by an authorised officer and be witnessed

(J) The transfer must be executed by the transferee and be witnessed, or be executed on their behalf by the following:

  • attorney and witnessed
  • authorised officer and witnessed
  • licensed conveyancer and witnessed
  • solicitor or barrister.
