On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Complete a Transfer of Interest

  This information aims to help you complete an electronic Transfer of interest (Mortgage or Charge).

   NOTE: A Transfer of Interest which affects a lease, must be lodged as a Transfer of Lease.

  Titles

   Select the land title reference(s) affected by the mortgage or charge being transferred.

  Interest in land

   Type of interest (mortgage/charge)
   Insert the registered interest dealing number.

  Transferor details

   The transferor name is specified in this field (and in the case of a corporation must include its ACN). The transferor          name must be identical to the name of the registered proprietor as shown on the Register.
   If the transferor name does not match the Register, a justification for name discrepancy must be provided.

  Transferee details

   Tenancy type

   If there is only one transferee, select sole proprietor.
   If there is more than one transferee, select one of the following

  • Joint tenants - a tenancy held by two or more proprietors intending to act and be treated as if they are one proprietor.
  • Tenants in common - a tenancy involving two or more parties and intending to be able to separately deal with their share in the same property.

If the tenancy type is tenants in common, the share of each transferee must also be specified.
The transferee name is specified in this field (and in the case of a corporation must include its ACN).
