On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Creation of separate folios of the Register

Separate folios of the Register may be requested:

  • for the lots comprised in an auto consol folio
  • for shares where the registered proprietors hold as tenants in common
  • for the shares in a 'time sharing' development
  • for an estate in fee simple and the leasehold estate or
  • for a life estate and the estate in remainder.

NOTE:  The standard lodgment fee entitles the applicant to have only one folio of the Register created. Where more than one folio of the Register is to be created, an extra lodgment fee will be charged for each additional folio. The total fee for the dealing will be equal to the standard lodgment fee x the number of folios of the Register required.

(B) The reference to title for the land affected by the request must be stated.

(C) Does not apply.

(E) The full names of all of the registered proprietors must be stated and be identical to the names as shown on the Torrens Title Register.

(F) A short description of the nature of the request must be stated.

(G) Full details of the request must be stated.

Instructions for the preparation of the new folios of the Register must be set out, i.e. specify the lots or proprietors requiring separate folios.

(H) The dealing must be executed by all of the registered proprietors and be witnessed, or be executed on the registered proprietors behalf as follows:
