On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Australian Company Number (ACN) or Australian Business Number (ABN)


When an Australian company is a party to a transaction involving Torrens Title land, Water Access Licence or a deed that is lodged for registration with NSW LRS, the company’s Australian Company Number (ACN) or Australian Business Number (ABN) must be recorded on the dealing or document evidencing the transaction.

An ABN can be used instead of an ACN only if the last nine digits of the 11 digit ABN are the same as the company’s ACN.

The ACN or ABN must be recorded directly after the first reference to the company name on the dealing, plan or document.

Lodging parties should check ACNs and ABNs for accuracy prior to lodgment with NSW LRS. NSW LRS may issue requisitions to lodging parties if it cannot match the ACN or ABN with the company name shown on a dealing, plan or document. Lodging parties will be responsible for making any required amendments if NSW LRS identifies discrepancies after registration.

If a corporation has been deregistered since execution of the dealing, plan or document, lodging parties must provide evidence to NSW LRS that at the time of execution, the corporation was duly registered.
