On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Connection of withdrawal of caveat

Where a Withdrawal of Caveat form W-08WX is lodged before the completion of action related to service of notice on the caveator (either due to lodgment of a Service of Notice on Caveator form or an adverse dealing), refer the case to the Senior Examining Officer, SD6.

On the Service of Notice on Caveator lodged:

  • marginally note the Withdrawal of Caveat: 'Service of notice [WAL dealing number] unnecessary'
  • marginally note the Service of Notice On Caveator: 'Unnecessary, see WX [WAL dealing number]'
  • enter the Service of Notice on Caveator as 'HIST' and register the Withdrawal of Caveat and
  • advise the lodging party of the Service of Notice on Caveator of the action taken.

On the adverse dealing lodged:

  • marginally note the Withdrawal of Caveat: 'Service of notice re [adverse WAL dealing number] unnecessary'
  • marginally note the adverse dealing: 'Service of notice unnecessary, see WX [WAL dealing number]' and
  • register the Withdrawal of Caveat and the adverse dealing.
