On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. What is a Notice of Sale (NOS) form?

This form is used by NSW LRS to notify the local council, water supply authority and relevant rating authorities of changes in ownership of the properties. Legislation requires this form to be lodged in all cases where the registered proprietor name on title changes, including a change of name. The NOS form contains information regarding the transaction including the incoming owner’s details, date of the contract for sale, date of settlement and purchase price.
 
An electronic NOS (eNOS) is automatically generated as part of an electronic transaction. There is no need to complete a separate form.
 
However, in a very small number of instances, your legal representative may need to complete and lodge a separate form being an online free Notice of sale form available from NSW LRS Online, or a paper copy of the NOS form which is available to purchase from our office at Level 30, 175 Liverpool Street Sydney NSW for a nominal fee. Instructions for completion of the paper NOS are printed on the back of the form. Your legal representative will advise in the unlikely event you need to separately prepare and lodge a NOS form. Once a dealing is registered, the local council, water supply authority and relevant rating authorities are automatically informed of the change and their records are updated.
