On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Panel 1: Property Address

This panel must be completed in all circumstances for Real Property Act dealings. 

If the affected property has no postal address, the locality and Postcode must be supplied.  A P.O. Box is not acceptable. Only 1 address is required.

Panel 2: Name and Address for Service of Notices

This panel must be completed in all circumstances. Where the address is the same as that in Panel 1 an 'X' can be placed in the appropriate box.

Panel 3: Transaction Details

Either Part A or Part B must be completed, except for a change of name.

Part A must be fully completed if the property was acquired for a sum of money, i.e. sale.

Part B must be fully completed if the property was not acquired for a sum of money.

The date of acquisition must be:

Survivorship the date of death of the joint tenant.
Will or Intestacy the date of granting of probate or letters of administration.
Order of Court the date of the Order where it is an Order of vesting, otherwise the date of the dealing executed pursuant to the Order.
Other Reason the date of the dealing or deed if no other date is applicable.

Panel 4: Property Details

This panel must be fully completed for a transfer for value of land. 

The area must be shown in metric units and must be the area affected by the dealing. See conversion from imperial to metric units of measurement page.

If more than one property is included in the transaction, the total area of all of the properties involved must be stated. If the property being transferred is a Strata unit, the total area of the Strata lot(s) involved must be stated.

Panel 5: Contact Name and Address

This panel must be fully completed in all circumstances.

Transferees acting on their own behalf must supply details of their own name, address and telephone number.

Certification

This panel must be completed and signed by an appropriate person in all circumstances: see section 117(1A and 1B) Real Property Act 1900.
