On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. All dealings accompanied by a Notice of Sale or Transfer of Land (NOS) form 10-0520 which affect a manual folio also require a Manual Data Entry (MDE) form 10-0500 to be completed at the time of noting the delayed number on the Register.

When completing the MDE form the following guide should be followed:

Dealing number:  write in the dealing number of the related instrument.

1. Local Govt. Area (LGA):  complete from the certificate of title. If no certificate of title exists, e.g. partially cancelled, the MDE form should be completed commencing at Volume/Folio.

2. Estate Type:  must be completed.

3. Volume/Folio:  state the manual reference to title only. If additional manual references exist, or the land description exceeds 30 characters, complete the details on further MDE forms. If the dealing involves more than one reference with different registered proprietors, prepare separate MDE forms for each outcome.

4, 5. Reg. Prop.:  must be completed in all instances. If an interest or share is being transferred show all of the registered proprietors, and their interest or shares, as they will appear on the Register after registration

Manual Data Entry form action to be taken

Accept the dealing for lodgment and refer the case to SM1.

The MDE form is given the same number as the dealing; the number is written on the top right hand corner of the MDE form.

Separate the MDE form and place it in the appropriate tray for collection by Operations Section.
