On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Complete a National Mortgage

This information aims to help you complete an electronic National Mortgage.

Party type: 

Select one of the following to specify the party type of the mortgagor.

  • Organisation or
  • Individual

Party Name:

Current name of the mortgagor

Estate or Interest being mortgaged

Select the Estate type (Currently only Fee Simple or Perpetual Lease or Minerals or Leasehold Estate are available)

Land Titles Reference

Enter the title reference(s) affected by the mortgage.

Has the name of this party changed?

When selected a separate field will be provided to enter the details of the change of name.

Mortgagor details

  • Proprietor on title – select this option if the mortgage affects the current registered proprietor(s).
  • Incoming proprietor – select this option if the mortgage affects the incoming proprietor.

Where a change of name justification is required for the mortgagor.

Justification details

Select the appropriate reason from the list. The list, together with the evidence required to support each reason, can be found at:

Where a correction of a name is required:

  • for an individual, the justification reason ‘change of name’ should be selected
  • for a company, the justification reason ‘incorporated name change’ should be selected
  • the evidence date is the lodgment date or other if applicable and
  • the evidence document ID is N/A.

Tenancy type

If there is only one mortgagee, select sole proprietor.

If there is more than one mortgagee, select one of the following:

  • Joint tenants
  • Tenants in common

Party

The mortgagee name is specified in this field (and in the case of a corporation must include its ACN).

If the tenancy type is tenants in common, the share of each mortgagee must also be specified.

Terms and Conditions

This section is used to specify a set of terms, conditions and/or other legal details that may apply to a Mortgage.

LR memorandum ID

Specific mortgage provisions are specified in this field.

The document ID number of at least one memorandum that has been lodged and registered with the NSW Land Registry must be specified.

Note: Please insert the memorandum ID without the check digit at the end, e.g. Memorandum ID is AA123456R enter as AA123456 .

A standard Memorandum prepared by the NSW Land Registry may be used. The document ID number is Q860000.

Additional Terms and Conditions

Any further terms and conditions may be stated.
