Determination of lease by notice

A lease may be determined by notice pursuant to an express provision in the lease. 

(B) The reference to title for the land affected by the Request must be stated.

(C) The registered number of the lease must be stated. The reference to title for the land affected by the request must be stated.

(E) The full name of the applicant must be stated.

(F) A short description of the nature of the request must be stated.

(G) Full details of the request must be stated.

The Request form must be accompanied by a statutory declaration showing:

  1. evidence of service of valid notice on the lessee or evidence that the tenant has provided valid notice in accordance with the notice provisions of the lease. A copy of the notice should be annexed to the statutory declaration and
  2. the relevant clauses of the lease which permit the lessor to terminate the lease (extracts of those clauses should be annexed to the statutory declaration).

(H) The dealing must be executed by the applicant and be witnessed, or be executed on the applicant’s behalf as follows:
