On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Creation of a consolidated folio of the Register

Folios may be consolidated where separate folios exist for:

  • contiguous lots held by the same registered proprietor in separate folios. Here, one  auto consol computer folio will be created where a Request form 11R is lodged and accompanied by a written undertaking that the parcels will be held as a stable holding,  
  • the shares held by proprietors as tenants in common
  • the minerals and the land are held by the same registered proprietor, or
  • different estates, e.g. life estate, estate in remainder, leasehold.

An extra fee is payable for the issue of a new folio of the Register.

(B) The reference to title for the land affected by the request must be stated.

(C) Does not apply.

(E) The full names of all of the registered proprietors must be stated and be identical to the names as shown on the Torrens Title Register.

(F) A short description of the nature of the request must be stated.

(G) Full details of the request must be stated.

NOTE:  A deposited plan illustrating the parcel as a single lot may be required in some circumstances, for example when:

  • an undefined residue (or part residue) is consolidated with another title, lot or deposited plan or another residue/part residue of a title, or
  • a departmental plan or other plan defining minerals is consolidated with an existing fee simple title when the fee simple title excludes the minerals.

(H) The dealing must be executed by the registered proprietor and be witnessed, or be executed on the registered proprietor's behalf as follows:
