On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. The amendments have been made to reflect the legislative change to section 127 which now permits a sole director to execute a document where there is no company secretary.

4th dot point - 'A sole director where the company does not have a company secretary (for dealings executed on or after 23 February 2022)' added to list.
5th dot point amended to read - 'a sole director who is not also the company secretary provided the execution is expressed to be pursuant to the constitution of the company and/or the replaceable rules contained in the Corporations Act 2001 (NOTE: a sole director who is not also the company secretary may not execute pursuant to s127 Corporations Act 2001 prior to 23 February 2022).'

12 December 2022 National Mortgage Form Point 4,under 'The Mortgagor (corporation)' section of the 'Execution requirements for National Mortgage' table now reads:

05 February 2019 Subpoenas A subpoena must be served at the Cashiers, NSW Land Registry Service. The standard lodgement fee is payable by the party serving the subponea. The Subpoena together with the payment receipt are then referred to LDR. See Baalman And Wells, Land Titles Office Practice, Lawbook Co. 2001 [475.500].
