On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Minute Paper

The following applies to Torrens Title land and Water Access Licences.

Any requisition raised after a dealing has been accepted for lodgment must be set out on an electronic minute paper in ITS.

The case location must be updated in ITS.

Satisfaction of a Requisition

The following applies to Torrens Title land and Water Access Licences.

Proceed with registration if the case is put in order on satisfaction of a requisition.

If the case is still not in order for registration take the following action:

  • note the relevant requisition as satisfied in the Requisition module in ITS
  • update ITS and
  • direct the case as appropriate on the case location paper.

Whenever a response to a requisition is made, the case must be returned for further consideration to the Officer who raised the requisition.

Requisitions raised after lodgment

The following applies to Torrens Title land and Water Access Licences.

Where a requisition is raised after lodgment, a Requisition form 10-1100B is completed and forwarded to the lodging party. An initial time limit of 2 months applies to the requisition and on expiry, a 28 Day Notice of Intention to Reject is automatically sent to the lodging party.

Inquiries, uplifting/relodging of documents and other action taken as regards the requisition should be directed to the Client Services Counter, Customer Services Unit, NSW LRS.

Requisitions raised in Advance Lodgment

The following applies to Torrens Title land and Water Access Licences.

Where a dealing lodged in the Advance Lodgment facility is found to be not in order for registration it is refused lodgment. A Requisition form 10-1100A is completed, attached to the case and forwarded to the lodging party.

Where a dealing lodged in the Advance Lodgment facility is found to be not in order for registration after being accepted for lodgment, a Requisition form 10-1100B is completed in ITS and forwarded to the lodging party. A case location paper is prepared and the case is sent to the File Press.

Requisitions raised in Personal Lodgment

The following applies to Torrens Title land and Water Access Licences.

Where a dealing lodged in the Personal Lodgment facility is found to be not in order for registration it may be refused lodgment. The lodging party is informed of the nature of the objection and the objection is noted in the top right-hand corner of the dealing. If required, a Requisition form 10-1100A is completed, attached to the case and returned to the lodging party.

Where a dealing lodged in the Advance Lodgment facility is found to be not in order for registration after being accepted for lodgment, a Requisition form 10-1100B is completed in ITS and forwarded to the lodging party. A case location paper is prepared and the case is sent to the File Press.

Requisition form 10-1100A

The following applies to Torrens Title land and Water Access Licences.

Requisition form 10-1100A is used where the dealing has not been accepted for lodgment. The form shows the following information:

Address Window: the NSW LRS document Collection Box number of the lodging party.

Your Reference: the lodging party reference details, if supplied.

Table No: for NSW LRS use.

Date: the date of preparation of the form.

Items returned herewith: a description of all documents being returned.

A description of the document(s) affected and the details of the requisition(s).

Requisition form 10-1100B

The following applies to Torrens Title land and Water Access Licences.

Requisition form 10-1100B is used where the dealing has been accepted for lodgment. The form shows the following information:

Address Window: the NSW LRS document Collection Box number or name of the lodging party.

NSW LRS Reference: the leading dealing number of the case.

Your Reference: the lodging party reference details, if supplied.

Table No: for NSW LRS use.

Date: the date of preparation of the form. This date is used to calculate the rejection date.

A notice of rejection and forfeiture of the lodgment fee if the requisition is not satisfied within 3 months of the date of the form.

A dealing under requisition may be uplifted and relodged at the Client Services Counter, Customer Services Unit, NSW LRS.

A written request for an extension of time and/or for registration of dealings that are not affected by the requisition must be furnished at the Client Services Counter prior to the expiry of the time allowed.
