On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Execution of dealing forms

The following applies toReal Property Act (RPA) dealings, Water Access Licence (WAL) dealings and documents registered in the General Register.

A dealing must be signed by or on behalf of all the parties to the transaction. A General Register document must be signed or behalf of the party who is disposing of or burdened by the transaction. The dealing or document must bear original signatures. Adhesive labels with original signatures are not acceptable. Adhesive seals are acceptable. In most cases the authenticity of the execution must be attested by a witness.

If execution is not provided on the standard page of a RP or WAL dealing form, the page number and identification of the annexure containing the execution must be stated in the execution panel on the standard page.
