On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Reserves drainage and public

Drainage reserves

Land vested in a Local Council and dedicated as a drainage reserve was formerly protected by the entry of a Registrar Generals caveat numbered K200000D. This practice has been discontinued. The Registrar-General's caveat will be removed on registration of any dealing and, where the local council remains as registered proprietor, the following notification will be entered in the second schedule: 'the land within described is drainage reserve' (code DDR).

A Local Council may lodge a Request form 11R to record on the folio that land owned by the Council is dedicated as a drainage reserve.  

A Local Council may lodge a New Registered Proprietor form 04RP to record the vesting of land in the Local Council as a drainage reserve. 

Land intended for use as a drainage reserve may be transferred to a Local Council by lodgment of a Transfer For Public Reserve Or Drainage Reserve form 01TD.  

Public reserves

Land vested in a Local Council and dedicated as a public reserve was formerly protected by the entry of a Registrar Generals caveat numbered K200000P. This practice has been discontinued and the Registrar Generals caveat will be removed on registration of any dealing. Where the Local Council remains as proprietor of the land a notification: 'The Land Within Described Is Public Reserve' (code KP) is entered in the Second Schedule.

A Local Council may lodge a New Registered Proprietor form 04RP to record the vesting of land in the Local Council as a public reserve. 

Land intended for use as a public reserve may be transferred to a Local Council by lodgment of a Transfer For Public Reserve Or Drainage Reserve form 01TD.  

A local council may lodge a Request form 11R to reclassify a public reserve to operational land. The request must be accompanied by a copy of the relevant instrument effecting the reclassification.
