On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. (E) The applicant must be the New South Wales Land and Housing Corporation or Family and Community Services.

(F) Must state 'Application pursuant to section 46C Real Property Act 1900 and section 18 Community Housing Providers (Adoption of National Law) Act 2012'.

(G) Must state 'The applicant a statutory body constituted by section 6 Housing Act 2001, refers to the order published in Government Gazette No. … of the … Folio … , a copy of which is annexed hereto and marked 'A'. In accordance with the provisions of that order and as regards the land referred to in the schedule contained therein, requests the Registrar-General to :

  1. record … as registered proprietor pursuant to the provisions of section 46C Real Property Act 1900;
  2. record in the register that the land is held subject to the provisions of section 18 Community Housing Providers (Adoption of National Law) Act 2012; and
  3. remove lease(s) No(s) from the relevant folio(s) of the register

 A copy of the related Government Gazette notice must be furnished.


(H) The dealing must be executed by an authorised officer of the applicant, whose full name and position must be stated. The signature must be witnessed.

 
(I)  This section is to be completed where the notice of sale data (see NOS form above) has been forwarded to NSW LRS through the eNOS facility.
