On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. Order of Court vesting land in an Aboriginal Land Council

Dealing type - R

(A) Stamp duty - not required

NOS form - required. Panels 1, 2, 3 and 5 must be completed.

Standard form of Caveat - does not prevent registration.

Priority Notice noted on the Register - see Priority Notice page.

The standard lodgment fee is payable.

(B) Where the Order affects the First Schedule, the number of the relevant folio of the Register must be stated.

(C) Where the Order affects a registered Crown land lease shown in the Second Schedule, the registration number of the lease and the number of the relevant folio of the Register must be stated.

(E) The full name of the applicant must be stated.

(F) A short description of the nature of the request must be given.

(G) Full details of the request must be given.

The name of the Court issuing the Order, the Court file number, and the date of the Order must be stated.

(H) The dealing must be executed by the applicant and be witnessed, or be executed on the applicant's behalf as follows:

Staff processing information

Warning the dealing must not be rejected at lodgment without referral to the Senior Examining Officer.

If the Order is served without a Request form, a Request form 11R will be completed by the Examining Officer and accepted for lodgment. If the fee is not paid, a minute paper setting out the situation and a copy of the dealing must be forwarded to the Team Leader, Examination Branch REG33, for further referral to Finance Branch.

Place the case in a red packet and refer it by hand to SD6 who will in turn refer it by hand to Legal Division. The case location must be updated in ITS.

Note  A Notice of Severance of Joint Tenancy form is not required where a joint tenancy is severed by the Order.
