On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. NOS form - required for a change of unit entitlement. Panels 1 and 5 must be completed. Not required in all other instances.

If the Order relates to a by-law, that by-law must be registered in order for registration of this application to proceed.

Note  An existing Order does not prevent recording of the new order.

(A) The reference to title for the common property of the Strata scheme must be stated.

(C) The full name of the applicant must be stated.

An Owners Corporation must be identified as 'The Owners Strata Plan [registered number of the Strata plan'.

(D) The Strata plan number must be stated.

(E) The particular section of the Strata Schemes Management Act 2015 must be stated. A copy of the Order certified by the Civil and Administrative Tribunal must be annexed to the dealing.

s148, s149 or s150 Strata Schemes Management Act 2015 relate to an order affecting by-laws.

s236 Strata Schemes Management Act 2015 relates to an order affecting unit entitlement.

(F) The dealing must be executed by the applicant and be witnessed, or be executed on their behalf by the following:

(G) This section is to be completed where the notice of sale data (see NOS form above) has been forwarded to NSW LRS through the eNOS facility.
