On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. NOTE: This dealing type may be lodged as a Dealing with Exception provided it is accompanied by a completed Lodgment Rules Exception form. In all other instances, the electronic dealing must be used.

The discharge may only affect the interest or share of a charger and/or chargee, or part of the land.

An extra fee is payable where more than one charge by the same chargee is being discharged on the one form.

No extra fee is payable where separate Discharge of Charge forms affecting the same charge and executed by individual chargees are lodged together. The separate documents will be treated as a single dealing. The additional Discharge of Charge forms are attached to the initial dealing and are treated as an annexure for execution purposes.

 If you are seeking to have a charge removed in accordance with section 66 Real Property Act 1900 then this must be done by lodgment of a Request form.

(A) The reference to title for the land affected must be stated.

(C) The registered number of the charge being discharged must be stated.

(D) The full name of the chargee must be stated and must be identical to the name of the chargee as shown on the Register.

A change of name of the chargee must be supported by the appropriate evidence. In relation to a whole discharge, see Change of name of a proprietor being removed by a dealing lodged. In relation to a partial discharge, An Application to Record a New Registered Proprietor form pursuant to section 46C Real Property Act 1900 or Change or Name form must be lodged before the charge can be discharged.

Where a chargee has died a Notice of Death form or a Transmission Application form must be lodged before the charge can be discharged.

(E) If the charge is to be partially discharged, the full name of the affected charger must be stated and must be identical to the name as shown on the Register.

(F) Additional information may be added.

(G) The dealing must be executed by the chargee and be witnessed, or be executed on the chargee's behalf as follows:

1    A charge may be discharged by persons other than the chargee in the following instances:

  • upon certification by an officer of the Court pursuant to section 98 Conveyancing Act 1919
  • upon lodgment of a vesting Order pursuant to section 74 Trustee Act 1925 (infant or mentally incapable chargee) or section 75 Trustee Act 1925 (deceased chargee) or
  • upon lodgment of a discharge executed by the Australian Securities and Investment Commission (ASIC) pursuant to section 601AF Corporations Act 2001 (Commonwealth) in relation to deregistered companies.
