On 11 October 2021, the Real Property Amendment (Certificates of Title) Act 2021 commenced, which abolished the Certificates of Title (CTs) and the control of the right to deal (CoRD) framework. All existing CTs have been cancelled and CTs will no longer be issued. Existing CTs will not need to be produced, and CoRD holder consent will not be required, for a dealing or plan to be registered. All existing Guidelines subject to this change are currently being reviewed and will be updated to reflect these changes. (A) Stamp duty - not required

NOS form - required for resumption of land.  Panels 1, 2, 3B and 5 require completion.

Not required for resumption of an easement.

Standard form of Caveat - does not prevent registration.

Note  The terms resumption and acquisition are identical for NSW LRS purposes and apply to land or easements resumed pursuant to NSW or Commonwealth Government Acts.

(B) The reference to title for the land affected by the request must be stated. The land affected by the resumption must be identical to the land described in the true copy of the Government Gazette notice attached. If the resumption affects part of the land, the part must be fully described.

(C) The registered number of the interest affected by the request must be stated. The reference to title for the land affected by the request must be stated.

(E) The full name of the authority in which the land or easement is to be vested must be stated. The name of the authority must be identical to the name shown in the Government Gazette notice.

A resumption drawn in the name of Her Majesty Queen Elizabeth the Second on behalf of a responsible Minister must state the Minister's correct portfolio title and the appropriate department or authority, e.g. 'Her Majesty Queen Elizabeth the Second on behalf of the Minister for Police and Emergency Services for the Police Department'.

(F) A short description of the nature of the request must be stated.

(G) Full details of the request must be stated.

The date and folio number of the Government Gazette must be stated and agree with the copy of the Gazette notice. A true copy of the Gazette notice must be attached to the dealing.

(H) The dealing must be executed by the applicant and be witnessed, or be executed on the applicant's behalf as follows:
